1. Acceptance of Terms
By downloading, installing, or using the Agently mobile application ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
2. Description of Service
Agently is a business productivity tool designed for mobile money agents in Ghana. The App provides USSD transaction automation services to streamline agent operations including cash-in, cash-out, balance checks, and other mobile money transactions across MTN Mobile Money and Telecel Cash networks.
3. Subscription & Payment
Agently offers a 30-day free trial period starting from the date of first installation. After the trial period, a paid subscription is required to continue using the App.
- Monthly Plan: GHS 6.00 per month
- Quarterly Plan: GHS 15.30 per 3 months (15% discount)
Payments are processed securely through Google Play. Subscriptions are non-recurring. You must manually renew when your subscription expires. No automatic charges will be made.
4. Refund Policy
Due to the digital nature of the service, refunds are generally not provided once a subscription has been activated. If you experience technical issues preventing use of the App, please contact support for assistance.
5. User Responsibilities
- You are responsible for all transactions initiated through the App.
- You must ensure your mobile money PIN is entered manually and kept confidential.
- You must comply with all applicable laws and regulations regarding mobile money operations.
- You must hold a valid mobile money agent license where required.
- You are responsible for verifying all transaction details before confirming.
6. Security & PIN Handling
Agently does NOT store, transmit, or have access to your mobile money PIN. The App uses Android Accessibility Services to automate USSD menu navigation, but always stops at the PIN entry screen, requiring you to manually enter your PIN. Your PIN is entered directly into the network operator's USSD dialog.
7. Limitation of Liability
Agently is provided "as is" without warranty of any kind. We are not liable for:
- Transaction errors caused by network operator issues.
- Financial losses resulting from incorrect transaction details entered by the user.
- Service interruptions due to mobile network downtime.
- Any unauthorized access to your device or mobile money account.
8. Termination
We reserve the right to suspend or terminate your access to the App if you violate these terms or engage in fraudulent activity. You may stop using the App at any time by uninstalling it from your device.
9. Fraud Database
Agently provides a community-driven fraud database to help agents identify potentially fraudulent phone numbers. Reports are submitted voluntarily by agents and verified through aggregate community reports.
- Reports are anonymized. Your identity is never attached to a report.
- Phone numbers are stored by cryptographic hash (SHA-256) — the full number is never stored or transmitted to our servers. A masked partial display version is stored for identification purposes.
- The fraud database is informational only. Agently does not guarantee the accuracy of fraud reports and is not liable for transactions based on this data.
- Submitting false or malicious reports may result in account suspension.
10. Cloud Backup
Agently offers optional cloud backup of transaction history. By using this feature:
- Your transaction data is securely stored using Firebase cloud services.
- A unique 12-character recovery code is generated for cross-device restoration.
- You are solely responsible for keeping your recovery code safe.
- We are not liable for data loss resulting from lost or forgotten recovery codes.
- Backups can be deleted by contacting support.
11. Marketplace
Agently provides an in-app marketplace where agents can list and browse services. By using the Marketplace:
- You are responsible for the accuracy and legality of your listings.
- Prohibited items include counterfeit goods, illegal services, and misleading offers.
- We reserve the right to remove listings that violate these terms without notice.
- Agently is not a party to any transaction between buyers and sellers and is not liable for disputes, losses, or damages arising from marketplace transactions.
12. Community Forum
The Agently community forum allows agents to share knowledge and discuss topics. By participating:
- You agree not to post offensive, misleading, or illegal content.
- You agree not to harass, threaten, or impersonate other users.
- We reserve the right to remove posts and suspend accounts that violate these guidelines.
- Reported posts are reviewed by the Agently team.
13. Dynamic Configuration & Updates
Certain app parameters, including subscription pricing, trial period duration, and feature availability, may be updated remotely. Additionally:
- We may temporarily disable the App for scheduled maintenance.
- We may require you to update to a newer version of the App for security or functionality reasons.
- Active subscriptions are honored at their original rate until expiry.
- You will be notified in-app of any pricing changes before your next renewal.
- The App may receive over-the-air code updates (via Shorebird) without a full Play Store update. These updates contain only app code changes and do not affect your data. No personal information is transmitted to Shorebird during this process.
14. Remote Monitoring
Agently includes an optional Remote Monitoring feature that allows agents to share a read-only view of their daily transaction summary with a designated monitor (e.g., a supervisor or business owner).
- Agents generate a one-time 6-digit access code to share with their monitor. Codes expire after 10 minutes.
- Monitors can view the agent's daily summary (total cash in, cash out, closing balance) — no individual transactions or PINs are visible.
- Agents can view all active monitors and revoke access at any time from within the App.
- The agent is solely responsible for who they grant access to.
- Agently is not liable for any action taken by a monitor based on the data shared.
15. Referral Program
Agently offers a referral program that rewards subscribers who refer new paying users:
- Each device is assigned a unique referral code (e.g., AGT-XXXXXX) based on its device ID.
- New users may enter a referral code before subscribing. If their payment succeeds, the referrer earns 30 bonus days added to their subscription.
- A maximum of 5 successful referrals per account applies (subject to change via remote configuration).
- Bonus days have no cash value and are non-transferable.
- We reserve the right to modify, suspend, or terminate the referral program at any time. Referral abuse (e.g., self-referral, fake accounts) may result in forfeiture of bonus days and account suspension.
16. Changes to Terms
We may update these terms from time to time. Continued use of the App after changes constitutes acceptance of the updated terms. Major changes will be communicated through the App.
